ESMA Sets Conditions for Post-Trade Risk-Reduction Clearing Exemption
The European Securities and Markets Authority (ESMA) has set out conditions for providers and users of post-trade risk-reduction (PTRR) services to use an exemption from the clearing obligation under EMIR 3 for certain over-the-counter derivatives. The regulator published the requirements in a final report on October 20.
PTRR services are designed to reduce risk in derivatives portfolios after trades have been executed. ESMA said its rules cover the information providers must give participants, the way exercises are carried out, provider controls, record-keeping, and monitoring of use of the exemption.
The regulator said the framework is intended to facilitate PTRR while ensuring that the clearing-obligation exemption is used only under EMIR 3’s conditions. It also said the final rules seek to avoid adding requirements where existing rules already meet the relevant objectives. The draft regulatory technical standards now go to the European Commission for endorsement through the usual review process.
Why it matters
For firms and professional traders with OTC derivatives exposure, the requirements could shape how eligible portfolios are compressed or rebalanced without triggering the clearing obligation. The operational details matter: documentation, provider controls and record-keeping are part of the proposed safeguards, not optional back-office extras.
What to watch next
Watch for the European Commission’s endorsement of the draft standards and for implementation details from PTRR providers. Market participants should also assess whether their current portfolio-reduction workflows meet the conditions ESMA has specified.
